We collect, store, process and use personal data of suppliers, customers, other business partners and prospects, in particular contact details of contact persons, name, address, email address, telephone number, business partner numbers, purchase, order, delivery and billing data for the purpose of initiation, reasoning, handling of contractual relationships, including delivery, payment and any warranty or product liability.

5) Legal basis of processing

Your personal data will be processed according to the currently valid provisions of the General Data Protection Regulation (GDPR) and the Federal Data Protection Act (BDSG). The following legal bases are taken into account:

5.1) Consent Art. 6 para. 1 lit. a GDPR

To the extent you have given us consent to the processing of personal data, this is the legal basis for processing. You can revoke your consent at any time with effect for the

If the processing of your personal data is necessary for the implementation of the existing contracts between you and EIBENSTOCK, this is the legal basis for the processing. This applies accordingly to pre-contractual relationships.

5.3) Fulfillment of a legal obligation Art. 6 para. 1 lit. c GDPR

If there is a need to process your personal data on the basis of a legal obligation (such as tax legislation, tax code), this is the legal basis for processing.

5.4) Protection of vital interests Art. 6 para. 1 lit. d GDPR

If the processing of your personal data is necessary to protect the vital interests of your or another natural person, this is the legal basis for the processing.

5.5)  Protection of the legitimate interests of the person responsible or of a third party Art. 6 para. 1 lit. f GDPR

If the processing of your personal data takes place in order to safeguard our legitimate interests or which of a third party (e.g. business relationship maintenance, marketing and advertising, avoidance of economic damage by credit rating [Creditreform], certifications), this is the legal basis for the processing. In doing so, a balance is being made to safeguard your interests and fundamental rights.

Disclosure of personal data to third parties only occurs only if this is necessary for the fulfillment of the contract or if there is a legal obligation. Categories of the recipients of personal data may be:

7) Third country transfer

The data transfer to a third country does not take place and is not intended.

In principle, your personal data will be deleted or blocked as soon as the purpose of the storage is omitted. In addition, the data will be stored for as long as necessary to comply with the various storage and documentation obligations to which we are bound by applicable laws and regulations.

9) Data subject rights

As the affected party, you have the following rights:

• according to Art. 15 GDPR, you have the right to request information about your personal data processed by us;
• according to Art. 16 GDPR, you have the right to promptly request the correction or completion of your personal data stored by us;
• according to Art. 17 GDPR, you have the right to demand the deletion of your personal data stored by us;
• according to Art. 18 GDPR, you have the right to demand the restriction of the processing of your personal data;
• according to Art. 20 GDPR, you have the right to receive your personal information provided to us in a structured, common and machine-readable format;
• according to Art. 21 GDPR, you have the right to object to the processing of your personal data;

10)        Revocation of the consent of the data processing

You have the possibility to withdraw your consent in whole or in part at any time. The legality of the processing carried out until then remains unaffected.

11)        Obligation to provide data

You only need to provide the data necessary to implement a contract or pre-contractual relationship or if there is a legal obligation for the provision.

There is no business or contract implementation possible with us without the provision of the necessary data for processing.
